What is a divorce ?

Divorce is the common term for a dissolution of marriage . A dissolution of marriage is the ending of a marriage by court order .

A Contested Divorce is when both spouses do not agree on getting divorced, how property is divided, finances, or custody .

A Summary Consent Divorce is when both spouses agree on all aspects of the divorce. This includes how property is split, the separation of money and debt, and custody ( legal decision making and parenting time ).

A Default Divorce is when a spouse files for divorce and the other spouse cannot be found or does not respond to the filing .

Where do you file for divorce?

If there are not children involved, a divorce is filed at a Superior Court in the county where either spouse lives.

If there are children, the divorce is filed at a Superior Court location in the county where the children live.
